Deborah Serrano has filed a lawsuit against several individuals, claiming negligence led to her suffering significant injuries. The complaint was lodged in the Court of Common Pleas of Delaware County, Pennsylvania, on February 5, 2023. Serrano is seeking damages from Neal Williams, Kimberly Williams, John Sheridan Jr., and two unidentified parties referred to as John Does 1 and 2.
According to the complaint, Deborah Serrano alleges that on February 9, 2023, she suffered severe injuries due to an unlevel and uneven sidewalk located at or near the properties of Neal and Kimberly Williams at 2341 Armstrong Avenue and John Sheridan Jr. at 2345 Armstrong Avenue in Holmes, Pennsylvania. The lawsuit accuses these defendants of failing to maintain a safe passageway for pedestrians by neglecting necessary repairs or warnings about the defective condition of the sidewalk. Serrano claims that this negligence resulted in her sustaining multiple injuries including back and neck injuries, wrist and knee contusions, a left shoulder injury, and other musculoskeletal issues.
The plaintiff argues that the defendants knew or should have known about the hazardous condition but failed to take appropriate actions such as repairing the sidewalk or providing adequate warnings. She further accuses them of not inspecting the premises regularly to ensure safety standards were met. "The dangerous condition created a reasonably foreseeable risk," states Serrano's complaint, emphasizing that her injuries were directly caused by this oversight.
In addition to Neal Williams and Kimberly Williams, John Sheridan Jr., who also owns property adjacent to where the incident occurred, is named as a defendant for similar reasons. Furthermore, two unidentified individuals labeled as John Doe 1 (a contractor) and John Doe 2 (a subcontractor) are implicated for potentially having responsibilities related to maintaining the premises.
Serrano is demanding judgment against all defendants jointly or severally for damages not exceeding arbitration limits along with interest and costs incurred due to medical treatments necessitated by her injuries. She asserts that these expenses may continue indefinitely into the future due to ongoing pain and suffering caused by her impairments.
