Electic company sues clients, alleging breach of contract

An electric company has sued a group of associations for alleged breach of agreement.

Benfield Electric Co. Inc. filed a lawsuit Feb. 24 in U.S. District Court for the Middle District of Pennsylvania against: Classic Communities Corporation, doing business as Classic at Admiral’s Quap,; Classic at Copper Ridge; Classic at Summerield; DJH Associates; DJH Penn Valley Associates; DJH Victoria Abbey Associates; DVH Associates; DVH Associates; Hershey Road Associates; Linglestown Associates; Old Forge State; Silver Creek Development Co.; Susquehanna Summit; Upper Allen Investments; Weatherstone Associates; and West Hampden.

According to the lawsuit, Benfield was contracted to perform electrical work at several ongoing development projects in New Cumberland, Carlisle, Mechanicsburg, Harrisburg, York Have, Lemoyne and Enola, The suit states the defendants have failed to pay their outstanding balances owed, without explanation and despite having accepted the work and occupying the buildings serviced by the plaintiff between February 2013 and December 2014.

The plaintiff cites violation of the Pennsylvania Contractor and Subcontractor Payment Act.

Benfield seeks compensatory damages in the exact amount of $535,606.62, plus interest, attorney fees and court costs. It is represented by attorney Bryon Kaster of Dickie, McCamey & Chilcote in Philadelphia.
