A Pottstown, Pa. woman is suing a Sunoco gas station for injuries she sustained after slipping on a wet surface inside the company’s convenience store.
Attorney Richard L. Stutman, of the Verlin Law Offices in Bala Cynwyd, Pa., filed the premises liability lawsuit June 3 at the Philadelphia Court of Common Pleas on behalf of Kim Gibbs.
Named as defendants are Sunoco Inc., Nishan Investments, LLC and Pottstown Gas, Inc.
According to the complaint, Gibbs was walking inside the A-Plus store at 612 High St. in Pottstown on Feb. 13, 2010 when she slipped on water that had accumulated on the floor near the entranceway of the store.
The lawsuit accuses the defendants of allowing a dangerous condition to exist and for not placing mats at the entrance of the store to prevent water from being tracked throughout the business.
As a result of the incident, Gibbs sustained a knee contusion, lumbosacral sprain, post-traumatic myofascitis, a hip sprain, disc herniations and lumbar radiculopathy.
The complaint says Gibbs has been, and will be required to undergo medical attention, which will cause her to incur various expenses. The accident also has prevented Gibbs from carrying out her daily duties and activities, and is expected to cause her to continue to experience great financial loss, the lawsuit claims.
Gibbs demands judgment against the defendants in a sum in excess of $50,000.
The plaintiff has demanded a jury trial.
