Wal-Mart faces premises liability lawsuit

Wal-Mart is facing a premises liability lawsuit after a former customer claims to have sustained various physical injuries after taking a spill at one of the company’s stores.

Philadelphia attorney Eric J. Linder, of the Law Offices of Eric J. Linder, filed the slip-and-fall suit June 3 at the Philadelphia Court of Common Pleas on behalf of Hatfield resident Ngoc Luu and her husband, Kenny Chen.

The plaintiff’s are suing the Wal-Mart store at 1515 Bethlehem Pike in Hatfield for injuries Ngoc Luu alleges she received after falling on a wet and slippery floor surface.

Also named as defendants are Wal-Mart Stores, Inc., and Wal-Mart Stores East, Inc.

The plaintiffs accuse the company of negligence and carelessness in allowing a dangerous and hazardous condition to exist at a business patronized by members of the public.

According to the complaint, Luu sustained injuries to her back, shoulders, arms, legs, torso and extremities, as well as a severe shock to her nervous system, lumbar sprain and strain, muscle spasm, and headaches and jaw pain.

The lawsuit claims Luu has incurred vast medical expenses due to her injuries, and she has been prevented from carrying out her daily duties and activities. She has also suffered a loss of earnings and earning capacity.

The plaintiff seeks a judgment against the defendants in an amount in excess of $50,000.

The lawsuit also contains a loss of consortium count by which the husband also seeks a judgment against the defendants in an amount in excess of $50,000.

The non-jury matter awaits listing.
