Save-A-Lot faces personal injury claim

A Philadelphia woman is suing a city grocer for injuries she sustained when she slipped on spilled detergent at the store.

Philadelphia attorney Marc F. Greenfield, of the firm Spear, Greenfield & Richman, P.C., filed the premises liability lawsuit June 8 at the Philadelphia Court of Common Pleas on behalf of Francine Moore of the city’s Port Richmond neighborhood.

The complaint accuses the defendants, Save-A-Lot, Moran Foods Inc., and Supervalu, Inc., of negligence in allowing a dangerous condition to exist at the Save-A-Lot store at which the incident occurred, located at 3901 M St.

The civil complaint faults the defendants for not ensuring the aisles were clear and the floors dry at the store at the time of the incident.

As a result of her fall, Moore sustained various injuries, including two bulging discs in her back, cervical sprain and strain, lumbar sprain and strain, left shoulder sprain and strain, bilateral knee sprain and strain, and an aggravation of pre-existing conditions, according to the lawsuit.

The accident caused Moore to spend various sums of money on medical care, the suit states, and has caused her to undergo a great loss of earnings and earning capacity.

Moore seeks a judgment against the defendants in an amount not in excess of $50,000, plus attorney’s fees and related court costs.

The lawsuit contains three separate personal injury claims against the defendants.

The non-jury trial is scheduled for an arbitration hearing on Feb. 9, 2012, but the lawsuit states that a jury trial will be sought should the arbitration hearing be appealed.
