A Philadelphia couple is suing the city and a recreation department for injuries the wife sustained after falling at a city rec facility.
Attorney David B. Sherman, of the city firm Solomon, Sherman & Gabay, filed the slip-and-fall lawsuit June 15 at the Philadelphia Court of Common Pleas on behalf of Nabih and Dina Asid.
Named as defendants are Weccaco Playground and Department of Recreation, Philadelphia Recreation Company, Philadelphia Recreation Association and Philadelphia Recreation Advisory Council, and the City of Philadelphia.
According to the civil complaint, Nabih Asid was at the playground at 405-25 Queen Street in Philadelphia when she suddenly fell on a “large, uneven and separated area on the playground.”
The lawsuit accuses the defendants of allowing a dangerous and defective condition to exist and for failing to properly inspect an area used by members of the public.
As a result of the incident, Nabih Asid sustained injuries to her feet, ankles, back, legs and toes, all of which have caused her great pain and suffering and has affected her earning power.
The plaintiff has incurred various medical expenses to treat her injuries, the suit states, and she has incurred a “substantial wage loss to her great financial detriment and harm.”
The plaintiffs demand judgment against the defendants jointly and severally in an amount in excess of $50,000.
The non-jury matter is scheduled for an arbitration hearing Feb. 16, 2012.
