Attorneys for a Florida man who alleges he sustained personal injuries from his use of denture adhesive cream have filed a mass tort claim at Philadelphia Common Pleas Court.
Philadelphia lawyers Thomas R. Kline, Lee B. Balefsky and Michelle L. Tiger, of the city firm Kline & Specter, filed the civil action Sept. 14 on behalf of Kenneth Keyes of Port St. Lucie, FL.
The defendants named in the claim are The Procter & Gamble Company, The Procter & Gamble Distributing LLC, The Procter & Gamble Manufacturing Company and Ride Aid Corporation.
The lawsuit, which was filed as a short-form complaint in the court’s master denture adhesive cream docket, claims that Keyes suffered from zinc toxicity and nerve damages as a result of his use of the product Fixodent from about 1990 to the present day.
The illness caused the plaintiff to suffer numbness and tingling in his feet, fatigue, dizziness, pain and weakness in joints, and lack of balance and coordination, the lawsuit claims.
The complaint accuses the defendants of negligence, strict liability-design defect, strict liability-failure to warn, breach of implied warranties, gross negligence and malice, common law fraud and violations of Pennsylvania’s Consumer Protection Act.
Keyes prays for relief as set forth in the Third Amended Master Long form Complaint filed in the Denture Adhesive Cream Litigation in Philadelphia Common Pleas Court.
A jury trial has been demanded.
