A Philadelphia woman who claims she was injured at a local concert venue has filed a premises liability complaint against the venue owner and concert promoter.
Attorney John C. Capek, of the Philadelphia law firm of Gerson, Capek & Voron, filed the civil claim Oct. 20 at the Philadelphia Court of Common Pleas on behalf of Charelle Johnson, and her husband, Timothy Johnson.
The defendants named in the suit are Holy Ghost Headquarters Revival Center at the Met, Inc., Samuel Bennett, and Ballpark Figure Productions.
According to the complaint, Charelle Johnson was attending a staged concerted at a property at 848-58 North Broad St. in Philadelphia on April 25 of this year, when, after getting up from her seat, she became injured after tripping and falling on a “snare or trap” that existed in the floor.
As a result of the accident, Charelle Johnson suffered various physical injuries to her spine, limbs, bones, muscles, tendons, ligaments, nerves and tissues of her body, the lawsuit claims. These included an ankle fracture, as well as cervical, thoracic and lumbosacral sprain and strain, lumbar and cervical radiculitis and severe nervous shock.
Johnson also suffered aches, pains and mental anxiety and anguish as a result of her fall, the suit claims. Her daily duties, activities and occupation have been affected by her injuries, and she has been compelled to spend various sums of money on medical attention.
Through her lawsuit, Johnson accuses the defendants of negligence for failing to properly maintain and inspect the premises, failing to correct the defective and hazardous condition near the seating area, failing to warn individuals of the dangerous condition, failing to provide adequate lighting under the circumstances, and constructing or fabricating an “inherently dangerous design of the seat area at the aforesaid venue, which created a danger, snare or trap for business invitees.”
Johnson’s husband, Timothy, has a separate claim in the lawsuit in which he states that he has experienced financial loss for the services related to his wife’s treatment. He also claims he has been deprived of his wife’s companionship because of the incident in question.
Each plaintiff demands judgment against the defendants in a sum not in excess of $50,000, plus related costs.
An arbitration hearing has been scheduled for June 25, 2012.
