Alabama man files Risperdal mass tort claim in Phila. court

An Alabama man is claiming in a mass tort filing that his ingestion of the antipsychotic

drug Risperdal led him to develop Gynecomastia, or enlarged breast tissue in males.

Joseph Smith, who resides in the town of Eastaboga in Alabama, claims in his filing that he took the drug from 1997 through to 2008.

The lawsuit was filed as a short-form complaint in the master Risperdal litigation at Philadelphia’s Common Pleas Court July 16 by Mechanicsburg, Pa. attorney Steve D. Shadowen.

The defendants named in the suit are Ortho-McNeil-Janssen Pharmaceuticals, Janssen Pharmaceuticals Inc., Johnson & Johnson Co., Johnson & Johnson Pharmaceutical Research and Development LLC, Excerpta Medica Inc. and Elsevier Inc.

The mass tort claim accuses the defendants of negligence, negligence-design defect, fraud, strict product liability for failure to warn and design defect, breach of express and implied warranties, conspiracy, unfair and deceptive trade practices and violations of Pennsylvania’s Unfair Trade Practices and Consumer Protection Law.

The plaintiff seeks unspecified compensatory and punitive damages.

He claims personal injury and economic loss.

A jury trial has been demanded.
