PITTSBURGH - A woman is suing her former West Virginia-based industrial employer on allegations of retaliatory discrimination in her 2014 job dismissal, claiming that trouble started when her coworkers literally threw stones at her.
Cassandra Nutter filed a lawsuit against Atos Corp. of Buckhannon, W.Va, doing business in Washington County, in the U.S. District Court Western District of Pennsylvania on July 16, claiming gender discrimination in a June 2014 workplace incident
According to court documents, Nutter was employed full-time as an operator at the defendant’s Carroll Township location.
The suit states that on or about June 18, 2014, the “plaintiff was subjected to significant stone throwing by two … male co-employees.”
Alleging that co-workers threw 15 to 20 stones at her throughout the day despite her requests to stop, Nutter maintains that she had to consult with her doctor due to anxiety and was embarrassed due to overwhelming emotions.
The suit states that her position was in a male-dominated field. She sent photos of her bruised legs to her supervisor and filed a police report in late June.
The plaintiff asserts that she was suspended in August 2014 for driving her car on a pad, claiming that other male workers were not suspended for committing the same practices for which she was terminated.
Alleging civil rights violation and infringement of the Pennsylvania Human Relations Act, Nutter claims gender discrimination and retaliation. She contends pain, suffering, and humiliation.
The plaintiff seeks compensatory and punitive damages, attorneys’ fees, and court costs. She is represented by Wayne Ely, W. Charles Sipio, and Timothy Kolman of Holman Ely in Penndel.
