PHILADELPHIA – Counsel for a plaintiff in a motor vehicle action cited irreconcilable differences and professional considerations to the Philadelphia County Court of Common Pleas in seeking to withdraw his appearance.
Vlad Kushnir of VB Kushnir filed his withdrawal petition on July 6, in expressing his intention to no longer represent plaintiff James Pressley of Philadelphia. Kushnir pointed to “irreconcilable difference” that arose between himself and Pressley, in addition to “other professional considerations” which compelled him to withdraw from the case.
Should the Court deem it appropriate, Kushnir offered to provide more detail in an in-camera interview setting only. Kushnir notified Pressley of his desire to withdraw from the case on May 24 and explained to his then-client that he should take the following 30 days to secure new counsel. As of the date of Kushnir’s withdrawal petition, July 6, court records show Pressley had not done so.
A hearing on the withdrawal petition was scheduled for Aug. 11 in Court chambers at Philadelphia City Hall, and an arbitration hearing is currently scheduled for Sept. 16.
Pressley filed a Writ of Summons in December against Elco of Wayne, N.J., Enterprise Leasing Company Philadelphia of Elkins Park, Enterprise Holdings in St. Louis, Mo. and Empire Fire & Marine Insurance in Schaumburg, Ill., in connection with a car crash at a date, time and place his writ did not indicate.
Pressley claimed to have rented a car from Enterprise and had it struck by an unidentified vehicle. Pressley’s Writ of Summons sought recovery for his injuries, pursuant to uninsured motorist coverage.
Court records indicate the case is still in a preliminary stage at the present time, and no answers or discovery demands have been made from the defendants or their counsel yet.
The defendants are represented by Stephen A. Schuerle of Hohn & Schuerle and Alicia M. Nelson, all in Philadelphia, and Jessica N. Manis of Powers, Kirn & Associates in Trevose.
