Worker alleges Chalfont construction company failed to pay overtime

A Schuylkill Haven man is suing a construction company, alleging evasion of federal labor regulations in a challenge of his wage payments.

Charles H. Quandel of Schuykill Haven filed a lawsuit Aug. 12 against Doli Construction Corporation of Chalfont in U.S. District Court for the Middle District of Pennsylvania, alleging failure to pay the correct 1½ times his regular hourly wage overtime rate for hours worked in excess of 40 per workweek in violation of the Fair Labor Standards Act of 1938, during his 10-year period of employment.

According to the complaint, Quandel was a non-exempt, covered employee since 2005. The suit states the company is out of compliance with labor law by having failed to compensate the plaintiff correctly. The suit alleges the company’s actions were done willfully and repeatedly over time.

The plaintiff alleges he is owed varying amounts totaling more than tens of thousands of dollars for the years 2012 through 2015.

Quandel seeks liquidated (double) damages, monetary damages totaling more than $75,000 for unpaid overtime wages, interest, attorney fees and court costs. He is represented by attorney Frederick Fanelli of Fanelli, Evans & Patel in Pottsville.
