A Cumberland County couple is suing a Florida resort, alleging premises negligence in a slip and fall that they say left the wife with permanent, life-altering injuries.
Zehong “Jenny” Li and Song “Michael” Li filed a lawsuit Sept. 8 in U.S. District Court Middle District of Pennsylvania against Casa Marina Resort, Waldorf Astoria and Hilton Worldwide, alleging liability for injuries sustained in a fall on the defendants’ premises in 2013.
According to the complaint, the couple reserved a room at the Casa Marina Resort in Key West, Fla., for Sept. 4-6, 2013. The suit states the resort promoted itself as having easy access to water sports and other seaside recreational pursuits, including a swimming pier leading into the ocean.
The lawsuit states the Lis proceeded to use the swimming pier steps carefully and in observance of all rules, but the defendants were guilty of breach of duty to provide safe ingress to the water because Jenny Li slipped and fell, sustaining a broken arm.
Despite multiple surgeries, extensive medical treatment and physical therapy, the suit states, Jenny Li will never fully regain use of her arm and her left arm has been permanently scarred, reminding her of her suffering forever.
The plaintiffs allege loss of earning capacity, income, and marital consortium, along with medical expenses.
The Lis seek punitive damages of more than $500,000, interest, attorney fees and court costs. They are represented by attorney Bret Keisling of The Keisling Law Offices in Harrisburg.
