Couple sues Geico, claiming denial of insurance benefits

A Conewago Township couple is suing their automotive insurance company, claiming the company is denying them insurance benefits after a Dauphin County accident.

Kathryn Beers and Joseph Beers filed a lawsuit against Geico on Sept. 8 in the U.S. District Court for the Middle District of Pennsylvania seeking compensation when the insurance company, according to the claim, failed to provide underinsured motorist coverage.

According to the complaint, on or about Oct. 10, 2012, the Beers were involved in a two-vehicle crash at the intersection of state Route 743 and Ridge Road in Dauphin County. Kathryn Beers suffered, as a result of the crash, injuries that included chronic neck and thoracic pain, numbness and tingling sensation across her shoulder blades, a concussion and multiple contusions.

The other motorist’s insurance company settled a third-party claim and Geico consented to the settlement. The Beers, through counsel, made a claim to Geico for uninsured motorist coverage. According to the lawsuit, the Beers and Geico were unable to reach an agreement with regard to their entitlement to underinsured motorist benefits. The provisions of the Geico underinsured policy does not provide for arbitration.

The Beers, who are represented by David L. Lutz of the Angino and Lutz firm in Harrisburg, are seeking compensatory damages in an amount of more than $75,000 and in exclusive of interest and costs, and in excess of any jurisdictional amount requiring compulsory arbitration.
