A Butler man is suing his employer for the right to refuse a transfer to another facility so that he can remain nearby his disabled wife.
Clifford Anderson filed against Fayette Parts Service Inc. on Sept. 28 in the U.S. District Court of the Western District of Pennsylvania, citing violations of Americans with Disabilities Act, Family Medical Leave Act and Pennsylvania Human Relations Act.
According to the complaint, Anderson, a store clerk employed at the Butler branch since 2011, alleges that he was wrongfully terminated following an ultimatum that he transfer to Allison Park or lose his job. The plaintiff alleges that he previously advised his employer that his wife was ill and disabled and he needed be near the couples' residence in case of emergency. It is alleged that defendant's failure to accommodate him violated the law.
The plaintiff seeks lost back pay, lost future income, punitive damages, attorney fees and costs of litigation. He is represented by Colleen Ramage Johnston of Rothman Gordon of Pittsburgh.
