PHILADELPHIA — A former employee is suing a Hamburg foundry, alleging violations of the medical leave act.
Robert Zettlemoyer, of Hamburg, field a lawsuit in U.S. District Court for the Eastern District of Pennsylvania Jan. 6 against Fairmount Foundry Inc., alleging violations of the Family and Medical Leave Act of 1993.
According to the complaint, Zettlemoyer started working at Fairmount in January 2014 as a molder, and in February 2015, he requested FMLA leave for his daughter, who suffers from asthma and requires periodic hospitalization. After making the request, the suit says, Zettlemoyer was fired for allegedly violating Fairmount’s attendance policy. A day later, Zettlemoyer was rehired as a new employee and could not request FMLA leave, the lawsuit states.
Zettlemoyer seeks a jury trial, lost pay, lost bonuses, lost benefits, other financial losses, liquidated damages and compensatory damages for emotional pain and suffering, among other costs. He is represented by attorney Samuel A. Dion of Dion and Goldberger in Philadelphia.
