Colorado couple accuses Amtrak of negligence in fatal accident

PHILADELPHIA — A Colorado couple is suing Amtrak in a class action, alleging negligence in a fatal derailment.

Mark and Nicola Tulk, individually and on behalf of all others similarly situated, filed a lawsuit Aug. 6 in U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corporation, also known as Amtrak, and Brandon Bostian, alleging negligence, loss of consortium and wrongful death.

According to the complaint, Mark Tulk was a passenger on Train 188, traveling from Washington D.C. to New York on May 12, 2015. The suit states conductor, Brandon Bostian, maintained a velocity more than two times the limit around a dangerous curve, which derailed the train and caused the death of eight passengers and the severe injury of Tulk.  

The plaintiffs seek damages of $1 billion, attorney fees, court costs and a jury trial. They are represented by attorneys Jonathan and Lauren Schocher of Schochor, Federico and Staton PC in Baltimore, Read McCaffrey of Liddle & Robinson LLP in New York, and Evan K. Aidman of the Law Offices of Evan K. Aidman in Narberth, Pennsylvania.
