PITTSBURGH — A Pittsburgh carpenter’s union is suing a Dunmore construction company, alleging failure to pay labor fees.
Carpenters Combined Funds Inc., by administrator James R. Klein, filed a lawsuit Feb. 15 in U.S. District Court for the Western District of Pennsylvania against C.F. Bordo Inc., James Bordo, Ceaser F. Bordo and Leslis Bordo, alleging violations of the Employee Retirement Income Security Act (ERISA) and the Labor Management Relations Act of 1947 (LMRA).
According to the complaint, C.F. Bordo Inc. was engaged in the construction business and entered into a labor agreement with the carpenters’ union based in Pittsburgh. Pursuant to the agreement, the defendants were obligated to submit certain mostly payments to the plaintiff for pension, medical, annuity/savings, apprenticeship, and dues, the suit says.
The plaintiff alleges the defendant violated the agreement, the ERISA, and the LMRA by failing to make timely payments of principal contributions and wage deductions to the plaintiff for the period of September through December 2016. Together with interest and damages, the plaintiff says it is owed $241,333.
Carpenters Combined Funds Inc. seeks the aforementioned damages, damages of $10,756.39 from each individual defendant and costs of the suit. It is represented by attorney Jeffrey J. Leech of Tucker Arensberg PC, in Pittsburgh.
