Couple blames Whirlpool, 3M Purification for refrigerator malfunction

PHILADELPHIA — A Pittsburgh couple is suing Whirlpool and 3M Purification, alleging they were sold a defective and hazardous refrigerator.

Ronald Nestico and Ellen Nestico of Pittsburgh filed a lawsuit on March 4 in the U.S. District Court for the Eastern District of Pennsylvania against Whirlpool Corporation and 3M Purification Inc., alleging negligence, breach of warranties and strict liabilities.

According to the complaint, the Nesticos purchased a refrigerator from the defendants on June 26, 2015. The suit says on July 20, 2015, the water filter failed and water leaked from the product, causing extensive water damage to the plaintiffs’ property.

The plaintiffs allege the water damage and all other subsequent expenses imposed upon them were a direct result of the defendants’ negligence in selling a product with a preexisting malfunction.

The Nesticos seek damages of more than $129,617.34, plus costs, delay damages, damages of real property and attorney fees. They are represented by attorneys Joseph L. McGlynn and Raymond E. Mack of De Luca Levine LLC in Blue Bell.
