Oil-gas worker claims overtime pay violation

HARRISBURG — An oil and gas rig worker has filed a class-action suit against former employers over allegations of unpaid overtime compensation.

Randy Waltz, on behalf of himself and similarly situated employees, filed a lawsuit on March 17 in the U.S. District Court for the Middle District of Pennsylvania against Aveda Transportation and Energy Services Inc. and Rodan Transport USA Ltd., citing violations of the Fair Labor Standards Act (FLSA) and the Pennsylvania Minimum Wage Act (PMWA).

According to the complaint, Waltz was employed by the defendants, which perform services at oil and gas rigs throughout the United States, from May 2014 to May 2015. The plaintiff claims that he and other workers regularly worked in excess of 40 hours per week but were not properly compensated, in violation of the FLSA and the PMWA.

Waltz seeks class action designation, unpaid wages, prejudgment interest, liquidated damages, and litigation expenses. He is represented by Peter Winebrake, R. Andrew Santillo, and Mark J. Gottesfield of Winebrake & Santillo LLC, in Dresher.
