HARRISBURG — A fabrication company is suing a pipeline construction firm for allegations of unpaid products and services.
Appellation Pre-Fab LLC filed a lawsuit on March 24 in the U.S. District Court for the Middle District of Pennsylvania against Sheehan Pipeline Construction Company, citing breach of contract, unjust enrichment, and quantum meruit.
According to the complaint, Appellation Pre-Fab furnished labor and materials to the defendant pursuant to a written proposal, which was accepted by the defendant on Sept. 15, 2015. The agreement stipulated payment specifically for the fabrication of six 30-inch test heads and the materials to fabricate the same. The plaintiff claims that the defendant owes an outstanding principal amount of $207,096, after repeated demands for payment.
Appellation Pre-Fab seeks the principal amount of $207,096, court costs, post-judgment interest, and a trial by jury. It is represented by Charles J. Phillips and Thad M. Gelsinger of Leisawitz Heller Abramowitch Phillips PC, in Wyomissing.
