Rotten Records sues unidentified BitTorrent user for alleged copyright violation

PHILADELPHIA — A record company has filed a lawsuit alleging that a listener torrented their work in violation of copyright laws.

Rotten Records Inc. filed a lawsuit on March 21 in the U.S. District Court for the Eastern District of Pennsylvania against John Doe subscriber assigned IP address 76.124.012.27, citing violation of the United States Copyright Act of 1976.

According to the complaint, the plaintiff owns the copyright to the album “Goatwhore - The Eclipse of Ages into Black,” consisting of 15 songs. The plaintiff claims that the defendant is an online copyright infringer and BitTorrent user whose IP address was used to illegally distribute the plaintiff’s copyrighted work. The plaintiff avers that they did not authorize their material to be distributed through BitTorrent by the defendant.

Rotten Records Inc. seeks that the court permanently enjoin the defendant from continuing to infringe the copyrighted work, an order to remove the work from the defendant’s computer, statutory damages, attorneys’ fees, costs, and a trial by jury. It is represented by A. Jordan Rushie of Flynn Wirkus Young PC, in Philadelphia.
