Car salesman sues former employer over age discrimination allegations

PHILADELPHIA — A former salesman for a car dealership filed a lawsuit against the company over claims that he was fired as a result of age discrimination.

Richard Cerviello filed a lawsuit on March 2 in the U.S. District Court for the Eastern District of Pennsylvania against Reedman Toll LP, doing business as Reedman Toll Auto World, citing age discrimination under the ADEA.

According to the complaint, Cerviello was employed as a car salesman for the defendant from 2004 until July 2014, when he was terminated. The plaintiff was 69 at the time of termination. Prior to his termination and subsequent EEOC charge, the plaintiff claims he signed an agreement with a similarly situated salesman that he had to sell 10 cars a month on average.

As a result of an injury on the job, the plaintiff was absent from work for two and a half months, preventing him from selling enough cars to fulfill the agreement. The plaintiff avers that he was additionally treated in a discriminatory manner according to his age.

Cerviello seeks compensation for all lost pay and benefits, actual damages, double damages for willful violation of the ADEA, punitive damages, legal relief, costs, expense, statutory damages, and a trial by jury.
