Man blames ice cream shop for injuries allegedly sustained while waiting in line

HARRISBURG — A man is suing an ice cream shop for injuries he allegedly suffered from a fall when a door he was forced to lean against opened as he waited in line.

Philip H. Trevino filed a lawsuit on March 29 in the U.S. District Court for the Middle District of Pennsylvania against Bonkey’s, citing negligence.

Bonkey’s is in the business of selling ice cream and snowballs at retail locations in Pennsylvania and Delaware. According to his complaint, Trevino went to the Bonkey’s location in New Freedom, York County, Pennsylvania on May 22, 2015.

The plaintiff claims that he was forced to lean against a closed door because of a narrow walkway and extensive number of people also waiting in line. Trevino avers that the door had an inoperative lock and was defective, causing the door to open and leading him to fall on his back, neck, and head. The plaintiff asserts that his injuries were a direct result of the defendant’s negligence.

Trevino seeks damages in the amount of $100,000, costs, and a trial by jury. He is represented by Ronald S. Canter of The Law Offices of Ronald S. Canter LLC, Rockville, Maryland.
