Union trustees withdraw lawsuit against concrete company

HARRISBURG – Union fund trustees who sued a concrete company on a claim of failing to make timely contributions to their employees’ retirement fund voluntarily dismissed their own complaint after only a month.


Trustees James Hartman and Wilson Eshbach of the Laborers’ Union Local No. 1174 Pension Fund, Laborers’ Local No. 1174 Annuity Fund and Laborers’ Union Health and Welfare Fund filed a lawsuit Feb. 23 in the U.S. District Court for Middle District of Pennsylvania against Gentile Concrete Inc., alleging violation of a collective bargaining agreement.

However, they filed a notice of voluntary dismissal on March 22. They did so without prejudice.

Gentile Concrete was accused of failing to make timely contributions to its employees' retirement funds at the end of 2015.

Hartman and Eshbach were represented by attorney Charles W. Johnston in Camp Hill.
