Nurse sues Broomall Rehabilitation for unpaid wage allegations

PHILADELPHIA -- A nurse is suing Broomall Rehabilitation and Nursing Center for allegations of unpaid wages and unfair payment practices.

Mark Roberts filed a lawsuit on April 4 in the U.S. District Court for the Eastern District of Pennsylvania against Broomall Operating Company LP, doing business as Broomall Rehabilitation and Nursing Center, and Savasenior Care Administrative Services LLC, citing violations of the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment Collection Law.

On Nov. 20, 2015, a similar collective action suit was filed against the defendant for failure to pay wages and overtime for lunch breaks.

According to the complaint, Roberts began working for the defendant on Oct. 10, 2014 as a licensed practical nurse/charge nurse. The plaintiff claims the defendant encouraged him to clock out during his lunch breaks and clock out at the end of the day but keep working. Roberts avers he regularly worked in excess of 40 hours without receiving overtime compensation.

Roberts seeks liquidated and/or punitive damages, costs and expenses, and a trial by jury. He is represented by Ari R. Karpf of Karpf Karpf & Cerutti PC in Bensalem, Pa.
