Suit says misdiagnosis led to babies' brain damage

HARRISBURG – A medical center is being sued over a claim that a misdiagnosis of a pregnant woman’s condition led to her twins suffering from brain damage and reflux disease.

Kristin C. Haines and Paul Jay, as parents and natural guardians of Robert and Sophia Jay, filed a lawsuit March 28 in the U.S. District Court for the Middle District of Pennsylvania against Milton S. Hershey Medical Center alleging medical negligence.

On March 27, 2014, Haines, 25 weeks pregnant with twins, arrived at the medical center with complaints of shortness of breath for 24 hours after falling on her abdomen, the suit says. According to the lawsuit, following a CT scan, she was misdiagnosed with a pulmonary embolism and given Lovenox, which caused her massive internal bleeding in her abdominal wall.

Because of the treatment, the fetuses Haines was carrying suffered irreparable injuries, which included brain damage and reflux disease, according to the lawsuit.

They are seeking an amount in excess of the jurisdictional limit for a jury trial, plus costs, delay damages, and such other relief the court deems just and appropriate.

Haines and Jay, who are demanding a jury trial, are being represented by attorneys James E. Beasley Jr. and Dion G. Rassias of the Beasley Firm, L.L.C. of Philadelphia.
