Supply company owner accused of not paying for purchases

PHILADELPHIA — A building systems company is suing the owner and CEO of a supply company for allegedly failing to make payments for goods purchased on credit.

Clarkwestern Dietrich Building Systems LLC filed a lawsuit on April 11 in the U.S. District Court for the Eastern District of Pennsylvania against Robert W. Kempf, citing breach of contract.

At all times relevant to the case, the defendant was the president and CEO of George F. Kempf Building and Supply Company, a Pennsylvania corporation engaged in the business of supplying and distributing building materials, the suit says. The plaintiff claims that in 2012, Kempf Supply purchased building materials from the plaintiff on credit.

In 2014, the defendant allegedly requested the plaintiff extend their credit limit. On Nov. 14, 2014, the defendant signed a personal guaranty for all purchases made by Kempf Supply. The plaintiff seeks a judgment for $209,278.37 to cover alleged unpaid bills, plus attorney fees and court costs.
