PHILADELPHIA — A dental assistant is suing over allegations that her supervisor behaved in a discriminatory and harassing manner.
Erica Caldwell filed a lawsuit on April 21 in the U.S. District Court for the Eastern District of Pennsylvania against Dental Care Alliance LLC, citing violations of Title VII of the Civil Rights Act of 1964 and the Pennsylvania Human Relations Act.
According to the complaint, Caldwell began employment with the defendant on April 20, 2006, working as a dental assistant. On Oct. 25, 2013, the defendant acquired a new office manager who allegedly began to discriminate and harass the plaintiff, who is an African-American female, the suit claims. The plaintiff avers that the supervisor wrongfully disciplined her, made racial remarks, prohibited her from working overtime, and continues to discriminate against her.
Caldwell seeks compensation for wages and benefits to which she has allegedly been deprived, front pay, punitive and compensatory damages, pre- and post-judgment interest, costs, attorney and expert fees, and a trial by jury.
