PHILADELPHIA – Defense counsel for a litigant named in a motor vehicle accident lawsuit is seeking to exit the lawsuit, subsequent to an insurance dispute and court-ordered judgment.
Tamara Chasan filed a motion to withdraw appearance on March 29, since Konneh’s personal vehicle’s insurance coverage (from Titan Insurance) did not extend to the rental vehicle involved in this accident.
On Feb. 11, Titan won a declaratory judgment from Judge Linda Carpenter in Philadelphia County Court of Common Pleas. In a follow-up letter sent March 22, Konneh was informed of the judgment, and the news that Titan wouldn’t be representing him in this accident litigation. Chasan therefore sought to withdraw on behalf of herself and her firm, Margolis Edelstein.
A hearing in this matter was held this past Wednesday in Court chambers, at Philadelphia City Hall.
On Sept. 16, 2013, Massa Kromah of Philadelphia and Sekou Toure of Darby were passengers in a 2013 Ford Fusion rental vehicle secured by Bangale Konneh of Philadelphia. Together, along with Lusine Sesay of Chester, the foursome made their way traveling to Minnesota.
Along the way, Sesay operated the rental vehicle and when driving on Highway 90 East in Kildare, Wis., swerved off the road. This caused the rental vehicle to fly into a ditch, flip over several times and hit a tree. The plaintiffs believe the accident was caused by Konneh’s decision to allow Sesay to drive the rental vehicle, despite being aware Sesay had received a speeding ticket prior to the crash and was sleep-deprived.
Kromah allegedly suffered full-body injuries, including a broken nose, broken jaw, loss of consciousness and post-concussive syndrome.
In their lawsuit against Konneh, Sesay, Alamo Rent-A-Car of St. Louis, Mo., Ean Holdings of Tulsa, Okla., Enterprise Leasing Company of Philadelphia and ELCO Administrative Services of Wayne, N.J., the plaintiffs are each seeking damages in excess of $50,000, plus costs in this case.
The plaintiffs are represented by Christian C. Thompson in Newtown Square.
The defendants are represented by Alicia M. Nelson and Stephen A. Scheuerle of Hohn & Scheuerle and Kelly J. Fox of Gerolamo McNulty Divis & Lewbart, all in Philadelphia.
