Man says unwanted calls violated law

PHILADELPHIA — A man has filed a class-action lawsuit against Ditech Financial LLC, a Delaware corporation, citing alleged violation of telephone harassment statutes.

David Cooke filed a complaint on July 11 in the U.S. District Court for the Eastern District of Pennsylvania against Ditech Financial LLC, alleging that the Delaware corporation violated the law by contacting him several times on his cell phone.

According to the complaint, the plaintiff alleges that in 2014 and 2015 he was called several times despite his request for the calls to stop. The plaintiff holds Ditech Financial LLC responsible because the defendant allegedly contacted him using an automatic dialing system.

The plaintiff requests a trial by jury and seeks injunctive relief against the defendant, statutory damages, actual damages, and any further relief the court grants.
