PHILADELPHIA — Two people are suing motorist Thomas Correa and vehicle owner Howard Schmidt, alleging negligence in a traffic collision.

Karolina Zakiewicz and Daniel Branski filed a complaint on July 21 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that Correa failed to properly control the vehicle belonging to Schmidt.

According to the complaint, the plaintiffs allege that on Aug. 2, 2015, Zakiewicz and Branski sustained physical injuries including headaches, cervical disc injury and other serious injuries as the result of a vehicular collision. The plaintiffs hold the defendants responsible because they allege Correa, an employee of Schmidt's, failed to yield the right of way and didn't brake in time.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount in excess of $75,000 plus interest and court costs. They are represented by Robert S. Miller of Wapner, Newman, Wigrizer, Brecher & Miller in Philadelphia.
