Musical artist Red McFly accused of using photograph without permission

PHILADELPHIA – A UK photographer alleges that a Whitehall musical artist used his copyrighted works to promote his album without authorization.

Paul Henry Cordwell filed a complaint on July 25 in the U.S. District Court for the Eastern District of Pennsylvania against Kenjiro Lucas, also known as Red McFly, alleging copyright infringement.

According to the complaint, the plaintiff alleges that he suffered damages as the result of his copyrighted photograph of a jet plane being used without his consent by the defendant. The plaintiff holds Lucas responsible because the defendant allegedly used plaintiff's photograph on the cover of his album "Take Flight Society Clothing Presents: The Good Fly Young, Hosted by Red McFly" and failed to respond to the cease and desist demands served by plaintiff.

The plaintiff requests a trial by jury and seeks award actual damages to plaintiff, disgorgement, interest, permanent injunction against the defendant, and any further relief as the court grants. He is represented by James J. Halligan of Duane Morris LLP in Philadelphia.
