HARRISBURG — A man and his employer's insurance provider are suing The Goodyear Tire & Rubber Company and Bastian Tire Sales Inc., tire manufacturer and dealer, citing alleged product liability.
Arthur J. Hoffman and Erie Insurance Company of NY, as subrogee of S&C Operations Inc., filed a complaint in the U.S. District Court for the Middle District of Pennsylvania against the defendants alleging that they distributed a tire with a factory defect.
According to the complaint, the plaintiffs allege that on Oct. 8, 2014, Hoffman suffered physical injuries when he was driving a 2007 Mack truck for S&C Operations when the left steer tire failed, causing an accident in which Hoffman was injured. The plaintiffs hold The Goodyear Tire & Rubber Company and Bastian Tire Sales Inc. responsible because the defendants allegedly failed to inspect the tire for any defects before distributing it.
The plaintiffs request a trial by jury and seek judgment against the defendant in an amount in excess of $75,000 plus interest, court costs and any further relief the court grants. They are represented by Robert M. Caplan of White and Williams LLP in Philadelphia.
