Kraft Heinz says rebate requests were unsupported

PITTSBURGH — A Pennsylvania corporation is suing ACME Food products Company Inc., a New Jersey corporation, citing alleged breach of contract, fraud, and unjust enrichment.

Kraft Heinz Foods Company filed a complaint on Aug. 25 in the U.S. District Court for the Western District of Pennsylvania against ACME Food products Company, Inc. alleging that the New Jersey corporation participated in the plaintiff's program and claimed rebates for ineligible sales.

According to the complaint, the plaintiff alleges that in 2014 and 2015, Kraft Heinz Foods Company suffered damages to its business. The plaintiff holds ACME Food products Company Inc. responsible because the defendant allegedly asked the plaintiff for rebates but failed to provide the plaintiff with the requested documents to support its right to receive the rebates.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $75,000 plus interest, court costs and any further relief this court grants. It is represented by Alexander W. Saksen of Gordon & Rees LLP in Pittsburgh.
