Hamil Manufacturing Co. alleges pipes ordered were not delivered in timely manner

ERIE – A Trafford company claims a Virginia business failed to deliver ordered supplies on time.

Hamil Manufacturing Co. filed a complaint on Sept. 2 in the U.S. District Court for the Western District of Pennsylvania against Energy & Process Corp. alleging breach of contract.

According to the complaint, the plaintiff alleges that in 2013 it contracted with the defendant for pipes to be delivered in December 2013 and January 2014. The plaintiff holds Energy & Process Corp. responsible because the defendant allegedly failed to complete the delivery of the seamless stainless steel pipes ordered by plaintiff as required by their contractual agreement.

The plaintiff seeks judgment against the defendant in the amount of $908,619 plus interest at the rate of 6 percent per annum and any further relief the court grants. It is represented by Nicholas D. Krawec of Bernstein-Burkley, P.C. in Pittsburgh.
