Widow of Rodale employee seeks death benefits

Insurance 03

PHILADELPHIA — An administrator of the estate of a man killed in an automobile crash is suing Life Insurance Company of North America, Rodale Inc. and Cigna Corporation, alleging breach of contract.

Margaret Koller, individually and as administrator of the estate of her deceased husband, Jonathan Koller, filed a complaint on Oct. 20 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they denied her claim for accidental death benefits in connection with her husband's death on Sept. 9, 2015.

According to the complaint, the plaintiff alleges that she suffered damages from being denied the insurance benefits left by her husband, who had been a Rodale employee. The plaintiff holds the defendants responsible for allegedly denying benefits on grounds that her husband was intoxicated at the time of the crash, arguing that actual or alleged intoxication should not be a disqualifying factor.

The plaintiff requests a trial by jury and seeks payment of accidental death benefits, court costs and any further relief the court grants. She is represented by Mark K. Altemose of Cohen, Feeley, Altemose & Rambo, P.C. in Bethlehem.
