Otsuka America Pharmaceutical accused of using software after termination of agreement

PHILADELPHIA — A Pennsylvania corporation is suing Otsuka America Pharmaceutical Inc., a Maryland corporation, citing alleged breach of contract.

ASI Business Solutions Inc. filed a complaint on Oct. 21 in the U.S. District Court for the Eastern District of Pennsylvania against Otsuka America Pharmaceutical Inc. alleging that the Maryland corporation continued to use the plaintiff's software even after the termination of its agreement with the plaintiff.

According to the complaint, the plaintiff alleges that ASI Business Solutions Inc. suffered damages to its business as the result of its software being used without a license. The plaintiff holds Otsuka America Pharmaceutical Inc. responsible because the defendant allegedly allowed a third party access to the plaintiff's software.

The plaintiff seeks an order for the defendant to return or destroy all the plaintiff's confidential information, a ban on the defendant's further use of the plaintiff's confidential information, an order for the defendant to return all confidential information it has disclosed to third parties, and all court costs. It is represented by Thomas B. Fiddler of White and Williams LLP in Philadelphia.
