Federal government liable for injury during childbirth, couple say

HARRISBURG — A couple's lawsuit on behalf of themselves and their minor child seeks damages from the federal government for an injury the child allegedly suffered during the course of a cesarean delivery at Keystone Rural Health Center in Chambersburg.

Luis M. Millan Diaz and Monica A. Nottola, his wife, individually and Luis M. Millan Diaz, as parent and natural guardian of F.A.M.N., filed a complaint on Nov. 4 in the U.S. District Court for the Middle District of Pennsylvania, alleging that a physician at the federally funded health center failed to provide proper medical care when Nottola was giving birth to F.A.M.N.

According to the complaint, the plaintiffs allege that in 2014, F.A.M.N. suffered a serious laceration during a cesarean as a result of negligence in care, and they hold the United States of America responsible for damages.

The plaintiffs seek judgment against the defendant for compensatory damages and any further relief this court grants. They are represented by Philip S. Cosentino of Diloreto, Cosentino & Bolinger PC in Chambersburg.
