Medical malpractice 05

PHILADELPHIA — A passenger is suing National Railroad Passenger Corp., a/k/a Amtrak, a train operator, citing alleged insufficient measures were taken to prevent injuries and negligence.

Rebecca T. Bibb filed a complaint on Nov. 21, in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corp., a/k/a Amtrak alleging that the train operator failed to properly maintain their train.

According to the complaint, the plaintiff alleges that, in May 2015, she sustained serious physical injuries from being thrown when the train she was riding in derailed. The plaintiff holds National Railroad Passenger Cor., a/k/a Amtrak responsible because the defendant allegedly failed to implement safety measures to ensure that their trains won't go over the speed limit.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory damages, punitive damages, interest, court costs and any further relief this court grants. She is represented by Cara J. Luther of Baum Hedlund, Aristei & Goldman in Philadelphia and Ronald L.M. Goldman, Timothy A. Loranger, and Frances M. Phares of Baum Hedlund, Aristei & Goldman in Los Angeles.
