Man who says he fell, had two toes partially cut off by mower, sues

PITTSBURGH — A man is suing Stanley Michaels, a property owner, alleging negligence and insufficient measures taken to prevent injuries.

Matthew McDonald filed a complaint on Oct. 27 in the Court of Common Pleas of Allegheny County against Michaels, alleging that the property owner failed to remedy defects of a lawn mower the defendant was using on the plaintiff's property.

According to the complaint, the plaintiff alleges that in September, he sustained physical injuries when he was asked to mow the defendant's property.

The complaint says McDonald slipped and his foot came in contact with the blades of the mower, on which the stop lever did not work. The plaintiff holds Michaels responsible because the defendant allegedly failed to inform or warn the plaintiff regarding the defective nature of the mower.

The complaint says McDonald suffered the partial amputation of two toes.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds $35,000 plus court costs. He is represented by Kevin R. Lomupo of Gilardi, Oliver & Lomupo in Pittsburgh.
