ERIE – A former Corapolis business is accused of not distributing plan assets to employees after it ceased operations.
Thomas Perez, secretary of labor, United States Department of Labor filed a complaint on Dec. 9 in the U.S. District Court for the Western District of Pennsylvania against Authorized Factory Service Inc. citing the Employee Retirement Income Security Act.
According to the complaint, the defendant ceased operations in 2002 and has not appointed an administrator for its employee benefit plans. The plaintiff holds Authorized Factory Service Inc. responsible because the defendant allegedly failed to distribute to its employees their portion of the employer contribution account when the company ceased operation.
The plaintiff seeks remove the defendant from its position as a fiduciary with respect to the plan, order the distribution of plan assets to the participants and any further relief this court grants.
