A&H Sportswear, Global Trademarks claim patent, trademark infringement

PHILADELPHIA -- Two companies are suing a defendant based in China, alleging the defendant has been selling knock-offs of the plaintiffs' patented swimsuit designs and trademarks.

A&H Sportswear Co. Inc. and Global Trademarks Inc. filed a complaint on Dec. 22 in the U.S. District Court for the Eastern District of Pennsylvania against Luo Qi Yuan, alleging the defendant sells knock-off copies of the plaintiff's products and commits patent and trademark infringement.

According to the complaint, the plaintiffs allege they suffered damages to their business from having their swimsuit designs being copied and sold. The plaintiffs hold Luo Qi Yuan responsible because the defendant allegedly promotes and sells counterfeit copies of their best-selling swimsuit designs.

The plaintiffs request a trial by jury and seek a permanent injunction against the defendant, an order for the defendant to send all infringing materials to the plaintiffs, payment of profits to the plaintiffs plus treble damages, punitive damages, court costs and any further relief this court grants.
