PITTSBURGH — A married couple's lawsuit against Medline Industries Inc., an Illinois corporation, alleges negligence, product liability and loss of consortium.
Clyde A. Shiring and Marguerite T. Shiring filed a complaint on Nov. 18 in the Court of Common Pleas of Allegheny County against Medline Industries Inc., alleging that the Illinois corporation manufactured a defective rolling walker that is used for sitting and walking.
According to the complaint, the plaintiffs allege that in December 2014, Clyde A. Shiring suffered physical injuries including a skeletal hypertosis fracture with paravertebral hematoma when a wheel came off the walker, causing him to fall backward. The plaintiffs holds Medline Industries Inc. responsible because the defendant allegedly failed to properly design its product.
The plaintiffs request a trial by jury and seek judgment against the defendant in an amount that exceeds the arbitration limits of this court plus interest, court costs, delay damages and any further relief this court grants. They are represented by E. Richard Ogrodowski and Frederick B. Goldsmith of Goldsmith & Ogrodowski, LLC in Pittsburgh.
