PITTSBURGH — A Pennsylvania corporation is suing former employees Doreen McCune and Tywanda Zeigler and competitor Excel Companion Care, alleging breach of contract, violation of trade secrets law and tortious interference.
Seba Abode Inc., d/b/a BrightStar Care, filed a complaint on Nov. 18 in the Court of Common Pleas of Allegheny County against the defendants, alleging that McCune and Zeigler breached their non-compete agreements after going to work for Excel.
According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of losing a client. The plaintiff holds the defendants responsible because the defendants allegedly used plaintiff's business practices which they had access to during their employment with the plaintiff to lure the plaintiff's customer to instead do business with Excel.
The plaintiff requests a trial by jury and seeks actual damages, incidental and consequential damages, punitive damages, interest and any further relief this court grants. The plaintiff is represented by Emily E. Mahler and Kyle T. McGee of Margolis Edelstein in Pittsburgh.
