HARRISBURG — A Nebraska company is suing MTF Associates Inc.; Haubert Construction LLC, d/b/a Fogarty Homes; Fogarty Homes Inc.; JF Development Corporation; John Fogarty Custom Built Homes Inc., d/b/a Distinctive Homes by Fogarty; John T. Fogarty; and Randall E. Haubert, alleging copyright infringement.
Design Basics LLC, a Nebraska architecture firm, filed a complaint on Jan. 5 in the U.S. District Court for the Middle District of Pennsylvania against the Pennsylvania defendants, alleging that they made unauthorized copies of the plaintiff's architectural works.
According to the complaint, the plaintiff alleges that Design Basics LLC sustained damages to its business from having its works copied and reproduced without authority. The plaintiff holds the defendants responsible because the defendants allegedly marketed and advertised home plan designs that violated the plaintiffs' copyrights.
The plaintiff requests a trial by jury and seeks actual damages, profits, statutory damages, an injunction against the defendants, court costs and any further relief this court grants.
