Levittown woman says Acme Market's cart ramp caused her to fall while shopping

PHILADELPHIA – A Levittown woman has initiated legal action against a Newtown supermarket and its operating companies for injuries stemming from a fall at that same market.

Karen Ann Gloetzner filed a lawsuit on Jan. 19 in the Philadelphia County Court of Common Pleas, against Acme Market of Newtown, Acme Markets, Inc. of Harrisburg and J. Loew Property Management of Downingtown.

“Gloetzner was shopping in the Acme Market in Newtown, where she fell in the parking lot/sidewalk area, due to an uneven, unlevel or raised portion of the handicap cart ramp,” the complaint says.

Gloetzner claims the defendants failed to inspect, maintain and repair the store floor, or warn customers of the dangerous condition, while further alleging to have suffered bilateral contusion, strain and sprain of her knees in her fall.

The plaintiff is seeking damages, jointly and severally, not in excess of the jurisdiction’s arbitration limits, plus interest and costs.

The plaintiff is represented by Andrew C. Smialowicz of Clearfield & Kofsky, in Philadelphia.
