PITTSBURGH — A Pennsylvania corporation has filed a class-action lawsuit against EHT Pharmacy LLC and Specialty Care RX Limited Liability Company, both doing business as CUREXA, and John Does 1-10, New Jersey defendants, citing alleged violation of telephone harassment statutes.
New Leaf Recovery Services P.C. filed a complaint on Jan. 24 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they sent unsolicited fax messages to the plaintiff.
According to the complaint, the plaintiff alleges that New Leaf Recovery Services P.C. suffered damages from receiving advertisement fax messages. The plaintiff holds EHT Pharmacy LLC, and Specialty Care RX Limited Liability Company, both doing business as CUREXA, and John Does 1-10 responsible because the defendants allegedly sent advertisement fax messages to the plaintiff without prior consent.
The plaintiff seeks actual damages, statutory damages, an injunction, court costs and any further relief this court grants. It is represented by Clayton S. Morrow of Morrow & Artim, P.C. in Pittsburgh.
