MEDIA – A licensed construction and home remodeling firm has sued a local landlord, claiming she locked them out of a rental property of hers they were working in and leaving the remodeling firm’s owner without his tools.
Donohue Home Services of Clifton Heights filed suit on Jan. 4 in the Delaware County Court of Common Pleas, against Karen Shuster of Ardmore.
“At all times relevant herein and material thereto, the parties entered into an agreement that included plaintiff installing tile and kitchen cabinets and painting at defendant’s rental property, at the aforementioned, in exchange for $5,000, to begin on Dec. 1, 2016,” the complaint reads.
Donohue Home Services claims they were locked out of the rental property on Dec. 12, for reasons unknown. This left the plaintiff company’s owner, Andrew Donohue, unable to access his tools – a variety of equipment worth $1,965.00, and the defendant’s continued possession of same has negatively impacted his livelihood in the process, he says.
The case is scheduled for an arbitration hearing on Oct. 2, at the Delaware County Courthouse in Media.
The plaintiff is seeking preliminary and permanent injunctive relief in the form of an order mandating the defendant to return the tools and equipment in question to the plaintiff (or alternatively, pay the plaintiff the fair market value for the tools of $1,965.00), attorney’s fees, costs and other relief.
