PHILADELPHIA – A Kunkletown couple have sued American Airlines, the City of Philadelphia and Philadelphia International Airport, alleging all three entities failed to protect one of the plaintiffs from injury on an airport tarmac.
George and Cynthia Rodriguez filed litigation on Jan. 23 in the Philadelphia County Court of Common Pleas, against American Airlines of Phoenix, Ariz., the City and Philadelphia International Airport, both with headquarters based in Philadelphia.
“On or about April 25, 2016, at or about 7 a.m., a dangerous, defective and/or negligent condition existed on the defendant’s airport tarmac as aforesaid and defendants knew or should or have known of the existence of same,” the suit says.
“On the aforesaid date, the plaintiff, George Rodriguez, was lawfully exiting an American Airlines flight and walking on the airport tarmac, when by reason of the negligence of the defendants, the plaintiff was caused to trip, slip, stumble and fall by reason of displaced and/or improperly aligned metal dividers,” the suit continues.
The plaintiffs claim the defendants failed to inspect or repair the condition on the tarmac or properly align the metal dividers, leading George to sustain injuries to his head, back, knee, eye and vision, plus nervous system shock and cognitive dysfunction.
George is seeking damages, jointly and severally, in excess of arbitration limits, while Cynthia is seeking an identical amount in damages for funds expended for George’s medical costs and loss of consortium.
The plaintiff is represented by Jeffrey M. Rosenbaum of Rosenbaum & Associates, in Philadelphia.
